SUBSCRIBER AGREEMENT AND TERMS OF USE FOR EPAPER

This Subscriber Agreement & Terms of Use for EPAPER (hereinafter referred to as the Agreement) governs the use & subscription of Easter Mirror (EM) epaper. By agreeing to this Agreement, you hereby agree and explicitly give your consent to activate your subscription to Eastern Mirror epaper, and agree to the terms and conditions contained herein.

1. SUBSCRIPTION
   
   By accepting this Agreement, you have agreed to be a Subscriber of Eastern Mirror epaper and shall have the right to access the epaper. By subscribing, you are deemed to accept all the Terms & Conditions contained in this agreement.
   
   The subscription shall be activated as promptly as possible, after such payments are made and after verification to information provided by the subscriber. It may be noted that EM reserves the right to reject any subscription at any time.
   
   Payments made are non-refundable and no refunds or credits is provided for any partial subscription period.
   
   The subscription fee and any other charges incurred in connection with use of this service, such as taxes and possible transaction fees, will be charged to Subscriber on the billing date.
   
   EM may change subscription plans and the price of epaper from time to time; however, any price changes or changes in the subscription plans shall be notified in advance and apply only to subsequent billing cycles.
   
   EM may also impose or limit any feature or restrict access to Subscriber to parts or all of the Product or Service without notice or liability.
   
   
2. SUBSCRIPTION PLANS/PACKAGES
   
   As given on epaper.easternmirrornagaland.com.
   
   
3. CANCELLATION/REFUNDS
   
   Only future charges associated with Subscriber’s subscription shall be cancelled at the time of cancellation of subscription and Subscriber will continue to have access to EM epaper service through the end of subscription period. The cancellation will only become effective at the end of Subscriber’s current billing period.
   
   Payments are non-refundable and no refunds or credits is provided for any unused subscription term or partially used subscription term.
   
   Upon cancellation of the subscription, the Subscriber shall not have access to new issues of the epaper. However, subscribers will still have access to the issues for the entire term already paid for till the end of the billing date.
   
   EM reserves the right to suspend or terminate or deactivate any subscription for any reason, with or without notice and without further obligation.
   
   
4. PAYMENTS/BILLING

   
   The Product and Services are as described in epaper.easternmirrornagaland.com website's homepage. Please read carefully the description of the product/service before proceeding with payment.

   Payment shall be made in advance for the Products and Services.

   All prices quoted are in Indian Rupees (INR), unless explicitly stated otherwise. EM reserves the right to change the prices at any time.

   EM cannot accept liability for a payment not reaching the EM account due to you quoting an incorrect account number or incorrect personal details or for any other fault. EM shall not accept liability if payment is refused or declined by the netbanking system/credit/debit card supplier for any reason.

   If the card supplier declines payment, EM is under no obligation to bring this fact to your notice. You should check with your bank/credit/debit card supplier that payment has been deducted from your account and reached EM.

   In no event, EM shall be liable for any loss, damages, compensation whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

5. CONTENT
   
   The epaper is for the Subscriber’s personal, non-commercial use only.
   
   The materials published or available (including, but not limited to texts, photographs, images, illustrations, designs, data, or compilations etc) are protected by copyright, and owned or controlled by EM.
   
   No right, title or interest is transferred to Subscriber through the subscription.
   
   The Subscriber is barred from copying, reproducing, republishing, uploading, posting, printing, transmitting, redistributing the epaper, in whole or in part, in any way, by way of email or other electronic means.
   
   The subscriber is barred from modifying the epaper. The use of the epaper on for any purpose other than personal, non-commercial use is a violation of the copyright, trademark and other proprietary rights, and is prohibited.
   
   
6. PRIVACY/INFORMATION
   
   The Subscriber hereby agrees to share and provide true, accurate and complete information, as required in the subscription form. This information shall not be disclosed to any other person or party unless deemed necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.
   
   
7.  DISCLAIMER OF WARRANTIES AND LIMITATIONS ON LIABILITY.
   
   THE SUBSCRIBER HEREBY AGREE THAT HIS OR HER ACCESS TO, AND USE OF THE EPAPER IS ON AN "AS-IS", "AS AVAILABLE" BASIS AND EM SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
   
   EM will not be liable to Subscriber in any way or in relation to the contents of, or use of, or otherwise in connection with the epaper.
   
   
8. INDEMNITY
   
   The Subscriber shall indemnify and hold harmless EM, its owner, agents, employees, officers, directors, shareholders, affiliates and assigns (as applicable) from all liabilities, claims, damages, costs and expenses, including reasonable attorneys’ fees and expenses, or actions, made by any third party or penalty imposed due to or arising out of Subscriber breach of this Agreement and/or other Policies, or violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
   
   
9. COPYRIGHT/ TRADEMARK
   
   All the materials published or available (including, but not limited to texts, photographs, images, illustrations, designs, data, or compilations etc) are protected by copyright, and owned or controlled by EM. Any inappropriate use, including but not limited to the copying, reproducing, republishing, uploading, posting, printing, transmitting or redistributing of any part of the epaper, or the whole part, is strictly prohibited, unless specifically authorised by EM.
   
   
10. APPLICABLE LAW
    
    This agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Dimapur, Nagaland.
